Terms and conditions of sale

Article 1 – Purpose

These general terms and conditions of sale (GTC) govern the contractual relationship between Julien Gérardy, acting as housing energy auditor (Audit Logement), PEB certifier, PEB officer and energy advisor, and his client. They apply to all services performed, quotes accepted and invoices issued, covering the housing energy audit (Audit Logement), PEB certification and PEB officer assignments.

Article 2 – Services

The services include:

• Housing energy audits (Audit Logement) to assess the energy performance of dwellings and propose improvements.
• PEB certification (Energy Performance of Buildings) to establish the energy compliance of properties.
• PEB officer assignments, ensuring that buildings comply with the energy standards in force during construction or renovation.
• Thermal analysis assignments aimed at identifying any cold spots in a building.

Article 3 – Quotes and orders

Any quote issued is valid for 30 days unless otherwise specified. Acceptance of the quote by the client constitutes a firm and definitive commitment on their part.

This quote is intended to be exhaustive in order to carry out the items it covers. However, should additional work become necessary due to negligence or a failure on the client's part, this will be billed separately at a rate of €100 per hour, VAT included.

Article 4 – Rates and payment terms

Rates are expressed in euros, excluding tax. They vary according to the service provided (audit, certification or PEB officer assignment) and are detailed in the quote. Invoices are payable in full within 8 days of their issue date, unless otherwise stated on the invoice. In the event of late payment, a first reminder will be sent free of charge.

If the consumer client fails to pay within the payment period specified in the first reminder (18 days), they will owe late-payment interest at the reference rate plus 8 percentage points, as well as a fixed compensation calculated as follows:

• €20 if the outstanding balance is €150 or less.
• €30 plus 10% of the amount due on the portion between €150.01 and €500, if the outstanding balance is between €150.01 and €500.
• €65 plus 5% of the amount due on the portion above €500, capped at €2,000, if the outstanding balance exceeds €500.

Article 5 – Right of withdrawal

The client has a 7-day right of withdrawal after accepting the quote, unless the service has already begun with the client's agreement or the cancellation request was submitted less than 48 hours before the start of the service.

Article 6 – Performance of services

The timeframes for performing the services are given for information purposes only and may vary depending on the nature of the service and the conditions of intervention. A delay cannot be invoked to claim compensation or request cancellation, except by prior agreement.

Article 7 – Liability

The housing energy auditor, PEB certifier and PEB officer undertakes to perform the services with care and in accordance with professional standards. However, he cannot be held liable for the consequences of incorrect or incomplete information provided by the client, nor in the event of force majeure.

Article 8 – Complaints

Any complaint relating to the performance of the services must be made in writing within 8 days of receipt of the report, certificate or invoice.

Article 9 – Dispute resolution

The parties agree to seek an amicable solution in the event of a dispute. Failing that, the courts of Namur shall have sole jurisdiction to resolve the dispute.

Article 10 – Data protection

Personal data collected in connection with the services is processed in accordance with the data protection regulations in force. This information will be used solely for the proper performance of the assignments.
